Family Mediation – how it works

back

Family Mediation is for separating and divorcing parents. It is a process that aids decision making and facilitates the writing up of agreements to cover arrangements for children, finances and property.

Mediation Information and Assessment meetings – MIAM

At first, you will be invited to one of our Information and Assessment meetings. This will allow you to find out more about mediation. We will also help you to assess whether mediation is suitable in your circumstances. The meeting lasts for approximately 45 minutes. There is no obligation for you to continue with mediation following this meeting. Should you wish to make an application to the court, we can supply you with the appropriate paperwork (form FM1) following the assessment meeting.

  • Meetings are usually arranged for each individual person – we can see couples jointly if preferred. Should you have any concerns for your safety with regard to a meeting with the other person, let us know and we will discuss ways to help you.
  • At the meeting we will assess if you are eligible to Legal Aid and if you are not, there will be a charge for the assessment meeting. Further details are below.

Mediation meetings

  • Once you have attended an assessment meeting you may wish to go on and use mediation rather than make an application to court. You can always use your mediated agreement. This is where couples meet together with a mediator for one or more meetings to discuss arrangements and make decisions about the future.
  • We will help you take time to look at all the options available so that you can reach agreements which work for everyone, particularly the children. Our mediators are experienced and skilled in working with couples from many different situations, ages, cultures and backgrounds.
